There are several documents that are unique to Alternative Dispute Resolution processes. For this class, your project will be to work on a Mediation Statement for one of two parties involved in litigation. The Mediation Statement is sent to the Mediator in advance of the Mediation to advise him/her of each party’s position. These are confidential documents that the Mediator uses to help evaluate the relative strengths and weaknesses of each party’s case. Uploaded under Course Resources/Student Files are General Facts regarding the Shaw v. Gibson case. You need to use these facts plus party-specific confidential facts to prepare a Mediation Statement on behalf of your client. If your last name begins with the letter AH, you will prepare a Mediation Statement on behalf of the Petitioner, Jerry Shaw. If your last name begins with the letter I – Z, you will prepare a Mediation Statement on behalf of the Respondent, Jennifer Gibson. I will send you the appropriate Confidential Facts for your party and you should use those facts and the General Facts to prepare your Mediation Statement.
